When a loved has passed away, there are responsibilities and needs that have to be attended to. Whether you are a loved one, the person nominated as Executor in a Will, or both, you will need help in administering the deceased person’s estate. The steps you take depend on the decedent’s personal and financial situation, and may not always require court involvement. Guardianship is a process used to protect an individual when he or she cannot protect themselves. A guardian is appointed by the court to make decisions on behalf of a person who suffers from a legal incapacity, whether such incapacity is because the individual is a minor, or an adult who suffers from a physical or mental impairment. In a guardianship proceeding, the court transfers some or all of the health care and financial decision making authority of an incompetent or mentally impaired person to the guardian.
